"A Matter of Time: Should Unlawfully Present Migrants Be Deported or Allowed to Remain?"

This talk will investigate if allowing unlawfully resident migrants to remain is preferable to states’ preferred policy of pursuing deportation.

Deportation is the main response of states to the presence of the millions of unlawfully resident migrants around the world. In reality, however, deportation is largely unsuccessful. In the EU, only about 40% of persons issued with deportation orders are actually removed from the EU. Instead, states should give serious consideration to regularising such migrants by granting them legal permission to remain in the state. One of the main criteria for evaluating if unlawfully present migrants should be allowed to remain is the passage of time. But how much time should a migrant have spent in a country before he or she should be allowed to remain?

Alan Desmond has been a lecturer at Leicester Law School at the University of Leicester since September 2016. Previously, he worked at third level institutions in Ireland, Italy and Poland and has been a Visiting Researcher at Harvard Law School and UCLA School of Law. He has delivered lectures on migrants’ rights at universities in Armenia, Ireland, Italy, Russia, Spain and the UK.

Before entering legal academia Alan worked as a freelance print and broadcast journalist and wrote a number of award-winning Irish language books.
